1. This contract describes the general terms and conditions applicable to the use of the services offered by the Wisify application and defines the rules of participation of registered users.
1.1.It is necessary to carefully read the contract before the use of the services provided in the WEB, and/or Wisify mobile application, which stipulate the terms in which the service is used, also defining the rules of participation of the professionals registered in that service.
1.2.If you do not accept the terms and conditions of this Agreement, you will not have the right to use the Wisify application or its services.
1.3.Acceptance is expressly conditioned to the manifestation of the user of all the terms and conditions of this contract, including the Privacy Policy.
1.4.Terms and conditions may be changed whenever Wisify considers it necessary, with prior notice of at least 15 days before the new conditions are entry into force, especially in case of price change.
2. Definition of terms
2.1.", Wisify", "we" or ", the company," means Wisify - Tech Solutions, Lda., NIF 514 946 920, with fiscal address in Matosinhos, Portugal.
2.2.The professional term defines everyone with access to the reserved area of โโpatient management and other features through the web version of the software.
2.3.The term patient defines everyone with access to the mobile version of the software provided by the professional to access their data.
2.4.The term receptionist defines everyone with access to the restricted web version of the software, made available by the professional for management and scheduling their consultations.
3. The Service - Professional
3.1.Wisify is a service that provides health professionals, namely nutritionists and diets, software for online management of nutrition and dietary consultations based on evidence.
3.2.The nutritionist can create the registration of his customers, from a web browser on computers or mobile devices, such as sociodemographic data, nutritional anamnesis and anthropometry, for the planning of food plans.
3.3.The nutritionist collects customer data in each consultation, thus allowing an overview of their evolution.
3.4.The software is divided into three relevant sections, namely the anamnesis section, which allows the collection of information in an interview situation, enabling the health professional to diagnose nutritional problems.This section also allows the calculation of energy needs through the various predictive equations, available by software, resting metabolism and physical activity factor.
3.5.The anthropometry section allows the study of the composition and shape of the body, according to the methodology of the international society for the advancement of kinesthropometry, for aid in the detection of nutritional problems or the study of dietary intervention.
3.6.Finally, the diet section allows the elaboration of food plans by the gram system, through the National Health Institute database. Recommended daily intake, proper intake and maximum tolerable intake level is available for male and female population (pregnant andBreastfeeding) For all age groups: Food and Nutrition Board, Institute of Medicine, National Academics.
4. Registration
4.1.The registration at Wisify is free, and is exclusive to nutritionists/dietites registered in the Order of Nutritionists as interns or effective members, or students of degree recognized by the Order of Nutritionists for access to the profession of nutritionist.
4.2.The professional benefits from a 15 -day experimental period.
4.3.Upon completion of the experimental period, the subscription will be automatically renewed with the applicable fee, except for prior cancellation by the user.
4.4.Wisify reserves the right to change the values โโof subscriptions.If there is a change, the user will be notified at least 15 days in advance, and the new rate will be applied to the billing cycle following the notification.
4.5.Wisify application reserves the right to request proof and/or additional data to verify the registration of personal data, as well as definitively or temporarily suspend users whose data verification was not possible.
4.6.Each interested party will correspond only to registration, and Wisify can cancel any subsequent records made by the same individual.
4.7.The account is unique, personal and non -transferable, and the same professional is forbidden to register or have more than one account.
4.8.The professional has 1 (one) week, from the date of registration, to activate the account.After this period, Wisify reserves the right to remove the account.
4.9.If the Wisify application detects distinct accounts with coincident or related data, they may suspend or cancel them.
4.10.The professional is required to maintain the confidentiality of his access password.
4.11.The professional is responsible for all operations done through your account.If you detect unauthorized use of your account, you should immediately inform Wisify.
5. GENERAL TERMS OF USE
5.1.Wisify may exclude the professional from using the service (eg from preventing him from logging in) if he has violated any of the conditions of this term of use.
5.2.Wisify is not responsible for any damage, loss or damage caused to users for system, server or internet failure.
5.3.Wisify is not responsible for the behavior of users.In breaking the current rules, the user will assume any and all responsibility, exempting Wisify of any responsibility.
5.4.Wisify does not guarantee continuous access to the service as interruptions may occur due to technical difficulties or internet failures.
5.5.Wisify does not guarantee the veracity, accuracy, adequacy, suitability or update of the information provided by the service.The responsibility for the use of information provided in the software is exclusive to the professional.
6. The Service - Patient
6.1.Access to the mobile app is available by the professional on the patient's profile page if the license has allowed it.
6.2.The patient can access their data from the Mobile App (Android), such as sociodemographic data, anthropometry, food plan, consultations and professional data (name, professional ballot, mobile phone number and workplace).
6.3.Access to the mobile app is dependent on the validity of the professional's license.Failure to renew the license removes the patient's access.
7. The service - receptionist
7.1.Access to the web version of the software is made available by the professional in the "Options" menu.
7.2.The receptionist can manage the scheduling of consultations of the professional, provided that the license is active.
8. Information Privacy
8.1.Data from users and their patients stored on the website https://app.wisifytech.com/ remain in the system for a period of 2 years after account expiration, unless data elimination request.
8.2.Personal data is processed and stored on servers that maintain a high level of safety and protection.
9. User Responsibility
By accepting these conditions of service, the user obliges:
9.1.Provide and maintain true, complete and updated personal data;
9.2.Maintain confidential access to your access to your website https://app.wisifytech.com/, assuming full responsibility for the actions taken with this registration, even by third parties;
9.3.Adopt behaviors that do not infringe the current legal order or injure legally protected positions;
9.4.As a nutritionist, take full responsibility for their acts before customers.
10. Cancellation and Refund Policy
The user may cancel the subscription at any time, with immediate effect on the next billing cycle.There is no refund for already invoiced periods.
11. Electronic Invoice
The user expressly recognizes and accepts that invoices related to the services provided by Wisify are issued electronically and sent to the email indicated when subscription to the service.
12. Intellectual property
All content and software offered by Wisify is protected by intellectual property rights, and its reproduction, distribution or use without express authorization is prohibited.
13. Applicable Law and Forum
The present conditions of service are governed by Portuguese law, and for the resolution of any dispute arising from their interpretation or execution, the parties agree to submit to the exclusive jurisdiction of the Courts of the District of Porto, Portugal.
